STATE/TERRITORY SPONSORED BUSINESS OWNER (PROVISIONAL) (163) VISA*
Key requirements
As an established business (es) owner or part-owner, applicants in this category need to show:
 
  • they must have obtained a sponsorship from a State/Territory government, which we will assist you with
  • they have a successful business career;
  • they are under 55 years of age,
  • There are no English language requirements for the 163 visa, although applicants who do not have at least functional English will need to pay an English language charge before visa grant.
 
The applicant needs to have a business which has had an annual turnover of at least $300,000 AUD for at least 2 of the last 4 fiscal years immediately before the application, or be a 'senior manager'
 
  • 'Senior manager' is defined in the Migration Regulations to be a person who has formal qualifications as the result of at least 3 years full time study (or part time equivalent), or
  • has at least 5 years 'appropriate experience', and
  • has at least 3 years post-qualification working experience in an area of employment which is pertinent to the qualification or 'appropriate experience', and
  • for at least 3 of the last 5 years immediately before the visa application, had a sound and continuous employment record in a position of a business which requires the applicant to
  • make decisions about the whole or a substantial part of the activities of the business, and
  • are responsible for the day to day running of the business or part of the business, and
  • subject to the business structure of the employer, has management responsibilities over other functional managers, and
  • If required by Australian law to be licensed or registered, is so licensed or registered.
 
If the business is one which provides professional, technical or trade services, they have not been involved in the provision of those services for more than 50% of their time – they must spend at least 50% of their time in the practice of active management on the business;
  • they (and spouse together) have total net business and personal assets of at least $250,000, which are legally acquired and capable of being transferred to Australia within 2 years, plus
  • an additional amount as determined by the sponsoring State/Territory to be sufficient for their settlement in Australia, (this is usually calculated approximately AUD $250,000.00)
They have a realistic commitment to
 
  • participate in Australia, as a substantial owner, in the management of a new or existing qualifying business which will benefit the Australian economy; and
  • maintain direct and continuous involvement in the management of the business(es) on a day to day basis, and making decisions affecting its direction and performance,
  • they (and spouse) have no history of involvement in business activities of a nature not acceptable in Australia;
  • they have signed a declaration acknowledging their obligations in regard to Australia's Business Skills migration requirements;
  • They can demonstrate that there is a need for them to be in Australia to conduct or establish the proposed business.
 
Your Permanent Residency Application
If you meet all of the requirements of your business visa after two years you will be able to obtain PR. This application will require you to provide evidence to the success of your business*.
 
Your New Australian Business
As part of your application for business sponsorship you will need to submit a business plan for your new Australian Business. We are will also assist you with this proposal.

When?
