I am nervous about asking my employer for a reference and don’t want them to know I intend to move to Australia.
Most assessing authorities will allow you to supply detailed statutory declarations outlining your experience and skills without your employer being notified. We have used statutory declarations very successfully to provide evidence of work experience.
I applied for a skill assessment and failed, does that mean I can’t migrate??
Not necessarily, we have recently had a client who failed a skill assessment simply because they did not supply enough evidence and the evidence supplied did not satisfy the criteria of the assessing authority.
When assisting you with your skills assessment we direct our clients to provide proof and documented evidence that targets the assessing authority’s criteria. We also supply our own detailed submission addressing the migration regulations and migration act to support your case.
I don’t want to commit to the cost of a visa if my assessment fails.
Nevile & Co Commercial Lawyers has a fee structure that is split into stages. You will be given the breakdown of charges and stages and are only committed to the stage you are at. If you wish to withdraw from your application or fail to meet criteria we will not be required to commit to the entire cost.
I am not planning on migrating for a year or so why should I apply now?
The skilled independent visa is a Permanent Residency visa. Permanent residency visas are valid for 5 years. Upon grant of your visa you will need to enter Australia before a specified date (usually within 6 months).
Once you have travelled to Australia and your visa is activated you may return any time in the next 5 years.
You will need to be aware there is a time limit of 2 years present in Australia to be eligible for a resident return visa. These two years can be at the start, end or in the middle and may be calculated of a collection of periods. Essentially this will give you the freedom of migrating when you are ready to with the knowledge you immigration status if confirmed.
The skilled visa process can be lengthy once you add the time to have a skilled assessment completed and we always suggest that if you are thinking of migrating between now and five years to get your application in before changes take place.
